UC DAVIS: VICE CHANCELLOR - ADMINISTRATION November 15, 2004 DEANS, DIRECTORS, DEPARTMENT CHAIRS, AND CAMPUS/UCDHS ADMINISTRATIVE OFFICERS RE: Sexual Harassment Policy Changes and Education Program Beginning January 1, 2005, and based on recent legislation (AB 1825), the University of California, Davis, will initiate a more comprehensive training program to require all new and continuing supervisors to attend a training session. The law establishes strict deadlines by which training must occur under AB 1825. Supervisors hired after January 1, 2005, must be trained within six months of hire. Supervisors already employed as of January 1, 2005, must be trained no later than January 1, 2006. If supervisors already received anti-harassment training any time after January 1, 2003, they do not need to be re-trained before the January 1, 2006, deadline. After January 1, 2006, employers must ensure that all supervisors receive follow-up training at least every two years. I want to restate several important aspects of our current UCD Sexual Harassment policy (PPM 380-12): III.C. 1. Department heads, managers, and supervisors shall: a. Prevent, correct, and discipline behavior that meets the definition of sexual harassment. b. Respond promptly and appropriately to each complaint of sexual harassment. c. Consult with the Sexual Harassment Education Program when a complaint is received. d. Implement sexual harassment education and training for all members of their administrative units. All complaints that come to the attention of a department head, manager or supervisor shall be reported to our central Sexual Harassment Program Unit (Campus: 530-752-9255; UCDHS: 916-734-5335). Prior to initiating an investigation of a complaint, the department head, manager or supervisor shall contact the campus or UCDHS Sexual Harassment Program Unit to receive guidance in appropriate next steps, including the possible use of an internal review or appointment of an individual to investigate the complaint. Members of the faculty and academic non-Senate employees may file formal complaints under applicable policies with the Vice Provost, Academic Personnel Office; students may file complaints under applicable policies with the Vice Chancellor-Student Affairs Office or Student Judicial Affairs; and staff may file complaints under the applicable personnel policy or union contract. Faculty, academic non-Senate members, students and staff may also directly contact the Sexual Harassment Office or a Sexual Harassment Advisor (http://www.hr.ucdavis.edu/Health_Services/Sexual_Harassment) to discuss their concerns and in order to receive advice regarding options. These calls may be anonymous. The caller may decide to pursue their issue either through the informal or formal complaint process.
