UC DAVIS: MATERIEL MANAGEMENT: PURCHASING May 13, 1998 DEANS, DIRECTORS, DEPARTMENT CHAIRPERSONS, AND CAMPUS/UCDMC ADMINISTRATIVE OFFICERS RE: Procurement of Foreign-Made Equipment, Materials, or Supplies Produced by Forced Labor, Convict, or Indentured Labor In March 1997, The Regents instituted the following University Policy on the Procurement of Foreign-Made Equipment, Materials, or Supplies Produced by Forced Labor, Convict, or Indentured Labor. It is the policy of the University of California that no foreign-made equipment, materials, or supplies furnished to the University of California shall be produced by forced labor, as defined in Section 1307 of Title 19 of the United States Code and Section 6108 of the California Public Contract Code,convict labor, or indentured labor under penal sanction. Pursuant to The Regents’ action, implementing administrative guidelines were issued by the University of California, Office of the President, on April 7, 1998. In accordance with these guidelines, the Purchasing Department will immediately incorporate appropriate contract provisions into all requests for quotations, purchase orders, and purchase contracts. Any seller contracting with the University who knew or should have known that the foreign-made equipment, materials, or supplies furnished to the University were produced in whole or in part by forced labor, convict labor, or indentured labor under penal sanction, when entering into a contract, may have sanctions imposed including voiding the contract and/or removing them from consideration for other University contracts for up to 360 days. The UC Davis Policy and Procedure Manual, Section 350-10, is being revised to incorporate this new policy. If you have any questions regarding this policy, please feel free to contact me at 757-8701.
